Terms of Use

1. Accepting these terms

By accessing or using the Klimate website, cloud dashboard, mobile app, Probe, or related services (together, the “Services”), you agree to these terms. If you use Klimate for an organisation, you confirm that you have authority to accept these terms for that organisation. If you do not agree, do not use the Services.

2. Your account

Give us accurate account information and keep it up to date. You are responsible for protecting your login details and for activity under your account. Tell us promptly if you believe your account has been compromised.

3. Using the Services

You may use Klimate only for lawful monitoring and management of systems, devices, networks, domains, and services that you own or are authorised to monitor. You are responsible for obtaining any permissions required from your organisation, customers, users, or network owners.

You must not:

• monitor or access systems without permission;
• use Klimate to harm, disrupt, probe, or attack another service;
• try to bypass security or usage limits;
• upload malicious code or interfere with the Services;
• reverse engineer the Services except where the law permits it; or
• use Klimate in a way that violates a law or another person’s rights.

4. The Klimate Probe

We give you a limited, non-exclusive, non-transferable licence to install and use the Probe only with the Services and for the period that you are entitled to use Klimate. You may make reasonable copies for authorised deployments, but you may not sell, sublicense, or distribute the Probe to others.

The Probe may update automatically to improve security, reliability, or compatibility. You are responsible for deploying it safely and for the systems on which it runs.

5. Your data

You keep ownership of the information and configurations you provide to Klimate. You give us permission to process them only as needed to provide, secure, support, and improve the Services. Our Privacy Policy explains how we handle personal information.

6. Klimate’s property

Klimate and its licensors own the Services, software, branding, documentation, and related intellectual property. These terms give you permission to use the Services; they do not transfer ownership to you. If you send us feedback, we may use it without restriction or payment.

7. Availability and alerts

We work to keep Klimate reliable, but the Services may sometimes be unavailable for maintenance, updates, or reasons outside our control. Monitoring results and alerts can be delayed, incomplete, or inaccurate. Klimate should not be your only safeguard for critical or life-safety systems.

8. Third-party services

Klimate may connect to or link to third-party services. Their own terms and privacy policies apply, and we are not responsible for their services or content.

9. Suspension and termination

You may stop using Klimate at any time. We may limit or suspend access if you break these terms, create a security risk, fail to pay an amount due, or if the law requires us to. Where practical, we will give you notice and a chance to resolve the issue.

10. Disclaimers

To the extent permitted by law, the Services are provided “as is” and “as available.” We do not promise that Klimate will always be uninterrupted, error-free, or suitable for every purpose. Nothing in these terms excludes a warranty or right that the law does not allow us to exclude.

11. Limitation of liability

To the extent permitted by law, Klimate will not be responsible for indirect, special, incidental, or consequential loss, or for lost profits, revenue, data, or business opportunities. Our total liability relating to the Services will not exceed the amount you paid Klimate for the Services during the 12 months before the event giving rise to the claim.

These limits do not apply where liability cannot legally be limited or excluded.

12. Changes to Klimate or these terms

We may improve, change, or discontinue parts of the Services. We may also update these terms. We will post the new terms here and provide reasonable notice of material changes. Continuing to use Klimate after the change takes effect means you accept the updated terms.

13. Governing law

These terms are governed by the laws of Ghana. The courts of Ghana will have jurisdiction over disputes, unless applicable consumer law gives you the right to bring a claim elsewhere.
